Grandparents Rights Respected by Flagstaff Attorneys

Our Attorneys of Flagstaff respect the rights of Grandparents and believe that they should be represented within the law as well. For many years, it was the case that the Grandparents were never even considered for guardianship or custody. Flagstaff Attorney Deborah Wilson and her Northern Arizona Lawyer Associates  of  Kaiser James & Wilson P.C  have always been advocates of the rights of Grandparents and accept every opportunity they can to represent these rights.

There are times when the natural parents of children cannot or will not tend to the needs of their children. Yet there are Grandparents fully capable and more than willing to step in and become the custodial parents of the grandchildren as either a temporary measure or permanent whatever the case may be. Although the willingness is there, the ease to bring this to pass is difficult and complex and requires the services of a Flagstaff Lawyer.

The first steps on the part of the Grandparents should be to seek out a Flagstaff Attorney and get some sound advice. The Flagstaff Attorneys will in no way turn their backs on their obligation to represent those that are in need of their expertise regardless of how complex the case may seem. Being as the right of Grandparents is just becoming recognized it is a new horizon for lawyers and many will shy away from complex issues. This is not the case and never has been the case with the Flagstaff Attorneys.

Once it has been determined that there is a valid case for the Grandparents to petition the Courts regarding their grandchildren it is time for the Flagstaff Lawyers to go into action.

Unfortunately, most often Grandparents feel that the only thing that should matter is the love and wanting the best for their Grandchildren and assume the Courts are going to see it that way. It will be the responsibility of the Flagstaff Lawyers to educate the Grandparents that the Law and the Courts have a different perception on how this will serve “the best interests” of the children.

Depending on the circumstances of the case, the Flagstaff Lawyers will be facing one of two stands that the Courts will take. The one stand will be the “parental rights”.This means the court will uphold the rights of the parents to have their children provided they can tend to their financial needs and meet the necessary responsibilities of parenthood then the children should remain with them. If this is an issue with the Grandparents then the Flagstaff Lawyers will build their case proving that these are not the circumstances in this instance.

The other stand that the Flagstaff lawyers may have to deal with is the ”best interests of the children”. This particular stand is one that is favored by the Flagstaff Attorneys because it means that the Court is adopting an open mind with the emphasis being put on the children as opposed to the parents. This gives the Attorneys of Flagstaff the opportunity to present their case based on the best interests of the child.

No matter which stand the Courts take the Flagstaff Lawyers are well educated, experienced and knowledgeable enough to be able to present a strong and worthy case to any Court hearing the matter.

A few things must be taken into account here. To begin with, the Flagstaff Lawyers do not agree to represent a case that does not have merit. These Flagstaff Attorneys hold a very high standard and do not believe in creating a case with no merit for the sake of obtaining legal fees. The Flagstaff Lawyers ethics do not allow for these types of actions. Therefore, one can rest assured that every case that the Attorneys of Flagstaff take on is going to be given their utmost attention and efforts.
